In consideration of being provided by the Coastside Running Club (“CRC”) with the opportunity to participate in Events (as defined below), I hereby voluntarily represent and agree as follows:

I am voluntarily participating in CRC’s runs, social gatherings, aid stations, classes, or other event(s), whether organized in writing or by word of mouth, as well as activities related thereto (collectively, the “Events”).  I am in good health and proper physical condition to participate in any of the Events. I know that participating in Events could involve potentially hazardous activities or situations, whether during the Event or while traveling in connection with the Event.  I assume all risks associated with participating in Events including but not limited to falls and injuries; contact with other Event participants, other people, or vehicles; the effects of the weather, such as heat, wind, cold, and wet or slippery conditions; and falling tree branches, wildlife, and other possible hazards.   I represent that such risks are known and appreciated by me.

I, for myself and anyone entitled to act on my behalf, waive, release, discharge, hold harmless, and covenant not to sue CRC, and all CRC directors, members, sponsors, and their representatives and successors (collectively, “Releasees”) from present and future claims or liabilities of any kind, known or unknown, arising out of my participation in Events, even if the claims or liabilities arise out of negligence or carelessness on the part of Releasees.

I grant full permission to CRC and its officers, members, and sponsors to use any photographs, videotapes, and any other record of my participation in Events for any purpose, although CRC will use its best efforts to avoid publishing a photograph if I express this preference in writing to the CRC president, web editor or any CRC director.

I expressly agree that this Liability Waiver and Release is intended to be as broad and inclusive as permitted by the laws of the State of California and shall be governed by and interpreted by the laws of the State of California. In the event that any clause or provision of this Liability Waiver and Release is held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the validity of the remaining provisions, which shall remain in full force and effect.
